Cyberspace Administration of China Releases Draft Regulations on Management of Generative AI Services (Soliciting Public Opinions)
On April 11, 2023, the Cyberspace Administration of China drafted the "Regulations on Management of Generative AI Services (Soliciting Public Opinions)", which consists of 21 articles, and publicly solicited opinions from society.
The draft regulations state that China supports independent innovation, promotion, and international cooperation of basic technologies such as artificial intelligence algorithms and frameworks, and encourages the use of secure and trustworthy software, tools, computing, and data resources.
The draft regulations also require that providers of generative AI products or services comply with legal requirements, respect social morality and public order, and reflect the core socialist values in the content generated by generative AI. Measures must be taken to prevent discrimination based on race, nationality, belief, country, region, gender, age, profession, etc. Intellectual property rights and business ethics must be respected, and unfair competition using advantages such as algorithms, data, and platforms is prohibited. The content generated by generative AI must be true and accurate, and measures must be taken to prevent the generation of false information. The regulations prohibit the harming of others' physical and mental health, damaging of portrait rights, reputation rights, and personal privacy, and infringement of intellectual property rights. Illegal acquisition, disclosure, and use of personal information and privacy, commercial secrets are also prohibited.
If a provider violates the provisions of these regulations, the Cyberspace Administration and relevant competent authorities shall punish them in accordance with the provisions of laws and administrative regulations.
